Josh Powell Camp Waiver

This is a waiver to protect JP Camp and your camper...It is an industry standard, but please bear with us through the legal verbiage:


       By agreeing to our terms of use at checkout, you are agreeing to the following:


(1)          JP Camp is the facilitator of a traditional outdoor camp, offering the safest place for campers to learn and grow, and you are the guardian of the camper you are signing up, whom be checking out terms of use box, you are agreeing to the following;


(2)           to assume all risk and responsibility involved with participation in any activities at the Josh Powell Day Camp and the property located at 5242 Wade Green Road, Acworth, Georgia 30102 (the “Camp Property”);


(3)           that the Camp Property contains a pond, that activities in or around the pond expose the undersigned to a certain level of risk, and that the undersigned will use the utmost care and attention when conducting activities in or near the pond and within the Camp Property generally;


(4)           to assume all risk and responsibility involved with his/her/its activities at the Camp Property;


(5)           to fully release No Cry Babies, LLC (the tenant/operator of the Camp Property) and Big Puddle, LLC (the landlord/owner of the Camp Property) and all of those entities’ owners, employees, agents, contractors, and affiliates,  from any and all liability, claims, and/or litigation that the undersigned may have for injuries, disability, death, or other damages of any kind;


(6)           the intent of this document is to waive any and all claims against No Cry Babies, LLC and Big Puddle, LLC that result from the ordinary negligence of such entities and/or those entities’ owners, employees, agents, contractors, and affiliates to the fullest extent of the law;


(7)           to the extent that the undersigned is a parent or guardian of a minor child participating in activities at the Camp Property, the undersigned acknowledges that the undersigned is executing this agreement on behalf of himself/herself and his/her minor child(ren), to the fullest extent permitted by law; and


(8)           to the extent that any provision in this agreement is held to be invalid or unenforceable, such provision shall be stricken and the remainder of this agreement shall remain in full force and effect.
